Labor Market Evaluations
In cases involving allegations of discrimination in employment or wrongful termination, we consider issues including loss of access to the local labor market, the potential to find comparable employment and mitigation of damages.
We determine what types of work activity the individual is qualified to perform and whether those jobs exist in sufficient numbers in the local labor market for the individual to be a competitive job seeker. We determine the person’s vocational options, including number, types, and wage level of jobs available and the individual's ability to compete in the open labor market.
We conduct a thorough labor market evaluation which includes employment numbers by occupations and by demographics, such as age, race, gender, and educational level to illustrate available employment options as well as any failure by the plaintiff to engage in a 'good faith' job search.
Individuals alleging an adverse impact on income as a result of wrongful termination or discrimination are required to make an effort to mitigate damages to reduce or minimize economic losses. We can evaluate the integrity of the job search to determine whether they have engaged in a good faith effort to secure comparable work.
